Sorry for the lack updates recently.  The decision was made to serve the lawsuit as instructed by the Judge rather than to appeal.  An appeal could be tied up in appeals court for 2 years or more, by serving as an agency as required by Judge Bucklew, they cannot delay beyond 60 days.  October 1, 2005 now becomes the deadline. The Wexler Suit has been filed also.

Judge Bucklew continued her defense of the IRS by denying the motion for default judgment and the motion to reconsider.  So monday I will start the appeal process.  The judge based her denial based on facts not in evidence.  Under the court's own rules that is a no-no and a clear error by the judge, therefore we appeal based on the record in the case.

Saturday July 2, 2005 
The amended Complaint was not filed.  No need, IRS DEFAULTED!  No response by the due date.  Last week was very busy with filing notice of default with the Court and visitors from as far away as Texas and the preparation of a similar lawsuit for our Texas friends to file.  Mississippi, Vermont and Mass. are next, with requests from North and South Carolina.  The process started Thursday with a copy mailed to Everson to comply with the Fed. R. Civ. P. to allow time for administrative settlememt or rebuttal. also last week eleven lawsuits were started against agents in the bay area.  Many have received their copies already, wouldn't you have loved to be a fly on the wall when the opened that envelope!  Another lawsuit for Florida Plaintiffs is being prepared today with Steve Wexler, St. Pete agreeing to be the primary plaintiff. Each person who wanted to join the first lawsuit will be contacted after the 4th of July with details.  Dave b

An amended complaint has been prepared that notices the Court as to the expected trespass by Department of Justice attorneys.
The amended complaint plugs possible holes in the "substantive regulation" based claim for damages.  This is based on new research discovered last weekend.  The document will be posted when filed.

Friday June 3, 2005
The process server in Washington called to tell us that the lawsuit service was made on Friday June 3, 2005.  They have 20 days to respond.  Response due by June 24, 2005.

Tuesday May 31, 2005
The lawsuit was filed in the Federal District Court Tampa Division.
